[A] Budget: Looking for Proposals
[B] Scope of Service:
(1) Vendor needs to provide legal services to the government authority located in Las Vegas, NV.
- Advice, consultation, representation, negotiation and preparation of employment contract with the superintendent, including, if necessary, possible litigation of the terms of the existing contract, and representation of the board in all matters regarding the superintendent’s performance under the contract. In addition, in rare circumstances, the firm may be asked to defend individual trustees, in any possible litigation.
- Assistance, consultation and guidance regarding preparation of board agendas and conduct of work sessions, special and regular meetings, including Roberts rules of order, Nevada open meeting laws, municipal law, and proper governance procedures, as well as legal guidance in respect of these areas of law.
- Advice and consultation with board members regarding CCSD compliance with laws of discrimination, federal civil rights laws and federal law mandating equal employment opportunities, including title vii of the civil rights act, the age discrimination employment act, individuals with disabilities education act, and title ix of the education amendments of 1972. Provide legal assistance in helping board monitor ongoing district compliance.
- Advice and consultation, in the board’s duty in approving collective bargaining negotiations with all bargaining units, including contract analysis. The purpose of this legal advice is helping board ensure that ongoing negotiations are in good faith with all bargaining units and counseling the board in its exercise of business judgment regarding the terms of collective bargaining agreements.
- Consultation and advice related to ethical conduct of the trustees as public elected officials, including conflict of interest, ethics complaints, election and campaign law.
- Consultation and advice related to legislation before the Nevada legislature, including, possible breakup of the school district, AB469 reorganization, and eliminating elected boards.
- Consultation and legal advice regarding the general and specific powers of the school board, including fiduciary duties of individual trustees and balanced governance.
- Advice and consultation related to constitutional issues of separation of church and state, use of district facilities by outside groups, first amendment free speech matters covering trustees, staff and students.
- Experience in administrative law, general contract law, governmental relations, and the Nevada legislative process is also desired. Please include information about qualification and abilities in these regards.
- Although the services will be provided to the members of the board of school trustees, familiarity with school law and Nevada statutes on education would also be helpful. Please include information about the depth and breadth of your knowledge and experience in these areas.
(2) Contract term will be one year.
